1. Introduction and Agreement

These Terms & Conditions ("Terms") govern your access to and use of the website and services operated by Taglio Studios ("Taglio Studios LLC," "we," "us," “Taglio Studios,” or "our"), including all products, custom works, memorials, content, features, and services offered through the website (collectively, the "Services").

By accessing, browsing, or purchasing from our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Services immediately

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. The most current version will always be posted on this page with the updated revision date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility and Use of Services

You must be at least 18 years old to place an order or use our Services. By using the Services, you represent that you are legally able to enter into binding agreements.

You agree not to use the Services in any way that violates applicable laws, infringes upon intellectual property rights, disrupts operations, or attempts to misuse, copy, or exploit our work, designs, or processes.

3.1 User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.2 Prohibited Conduct

You agree not to use the Services to:

Violate any applicable local, state, national, or international law.
Infringe upon the rights of others, including intellectual property rights.
Transmit any harmful code, viruses, or disruptive files.
Engage in any activity that interferes with the proper working of the Services.

4. Handmade Nature of Our Work

All Taglio Studios LLC pieces are individually handmade. Variations in color, size, shape, pattern, and finish are natural characteristics of hand-blown glass and are not considered defects.

Product photos are representative examples. Exact replication is neither possible nor guaranteed. By placing an order, you acknowledge and accept the inherent variation of handcrafted glass art.

4.1 Company Content

All content on the Services, including text, graphics, logos, images, video, audio, and the compilation thereof, is the property of Taglio Studios LLC or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

You are granted a non-exclusive, non-transferable, revocable license to access and use the Services strictly in accordance with these Terms for your personal, non-commercial use.

4.3 User Submissions

If you post, upload, input, provide, or submit content to the Services ("User Submissions"), you grant Taglio Studios LLC a perpetual, worldwide, irrevocable, non-exclusive, royalty-free license to use your User Submissions in connection with the operation of the business. You are solely responsible for your User Submissions and the consequences of posting or publishing them

5. Custom Orders and Memorial Pieces

Custom pieces and memorials are created specifically for each client and cannot be resold or reused.

All custom orders and memorial pieces are final sale.
Once production has begun, orders cannot be canceled, refunded, or returned for any reason, including but not limited to changes of mind, emotional response, or subjective dissatisfaction.

By submitting names, dates, inscriptions, or personalization details, you confirm that all information is accurate and approved for use. Taglio Studios LLC is not responsible for errors provided by the customer.

5.1 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

You agree to provide accurate billing and payment information and authorize us to charge your selected payment method for the total order amount, including applicable taxes and shipping.

5.2 Payment

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You agree to promptly update your account and other information, including your email address and payment method details, so that we can complete your transactions and contact you as needed.

5.3 Refunds/Cancellations

Due to the custom, handmade, and memorial nature of our work:

All custom orders and memorial pieces are final sale upon order placement. Once production has begun, orders cannot be canceled, refunded, or returned for any reason.
Ready-to-ship items may be eligible for return only if explicitly stated on the product listing
Shipping fees are non-refundable
Exceptions, if any, are at the sole discretion of Taglio Studios LLC.
Completion timelines are estimates and may vary due to the nature of handmade glass, kiln schedules, curing time, and material behavior. Delays related to craftsmanship do not constitute grounds for full cancellation or refund.

6. Shipping and Risk of Loss

Once an order has been shipped and accepted by the carrier, risk of loss transfers to the customer.

We carefully package all items, especially fragile glass. However, Taglio Studios LLC is not responsible for delays, loss, or damage caused by shipping carriers. Claims for shipping damage must be reported within 48 hours of delivery and supported with photos of the packaging and item.

7. Intellectual Property

All content on the Services, including designs, images, text, logos, product names, descriptions, and processes, are the exclusive property of Taglio Studios LLC and protected under intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit any content without prior written consent.

8. Disclaimer of Warranties

The Services and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Taglio Studios LLC disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of Liability

In no event shall Taglio Studios LLC be liable for indirect, incidental, special, consequential, or emotional damages, including loss of profits, loss of use, or loss of sentimental value, arising from the use of the Services or purchase of products.

Our total liability, if any, shall not exceed the amount paid for the product giving rise to the claim.

Emotional distress, grief-related dissatisfaction, or subjective response to memorial artwork does not constitute grounds for refund or liability.

10. Indemnification

You agree to indemnify and hold harmless Taglio Studios LLC, its owners, artists, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Governing Law

These Terms & Conditions, and any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any products or custom works provided by Taglio Studios LLC, shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms, the Services, or any transaction with Taglio Studios LLC shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and the parties hereby knowingly and irrevocably consent to the personal jurisdiction and venue of such courts.

Each party waives any objection to jurisdiction or venue, including any claim that such forum is inconvenient or improper.

12. Force Majeure

Taglio Studios LLC shall not be liable for any delay, failure, or inability to perform its obligations under these Terms where such delay or failure results from events beyond our reasonable control. These events may include, but are not limited to, acts of God, natural disasters, fire, flood, power outages, equipment or kiln failure, material shortages, labor disruptions, transportation or carrier delays, governmental actions, public health emergencies, or illness or incapacity affecting production.

In such circumstances, performance timelines may be extended without penalty, and such delays shall not constitute grounds for cancellation, refund, or liability.

13. Chargebacks and Payment Disputes

By placing an order with Taglio Studios LLC, you agree not to initiate a chargeback or payment dispute for any custom piece or memorial once production has begun or the order has been confirmed as final sale under these Terms.

In the event of a chargeback or dispute, Taglio Studios LLC reserves the right to provide order documentation, approval records, communication history, and these Terms & Conditions to the payment processor or financial institution to contest the claim. Initiating a chargeback in violation of these Terms may result in account termination and refusal of future service.

14. Right to Refuse or Cancel Orders

Taglio Studios LLC reserves the right, at its sole discretion, to refuse, decline, or cancel any order prior to the start of production. This may include, but is not limited to, orders containing inappropriate or unlawful requests, inaccurate or conflicting information, suspected fraud, abusive or harassing behavior, or requests that fall outside the scope of our artistic, ethical, or operational standards.

If an order is canceled by Taglio Studios LLC prior to production, any payments received may be refunded at our discretion. Once production has begun, all applicable final sale and no-refund provisions apply.

16. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Taglio Studios LLC.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

If an order is canceled by Taglio Studios LLC prior to production, any payments received may be refunded at our discretion. Once production has begun, all applicable final sale and no-refund provisions apply.
